FIB - Scams 101
?????????? VERY far-fetched ??????????

Helen T.,
That's a very strange post you made.
Why?
Because when a merchant loses money from a charged-back credit card transaction, there is a way for the merchant to get his money back and have the chargeback reversed. They simply dispute the chargeback through their merchant account provider and give PROOF that the customer is wrong for the reason they asked for the money back, and prove they (the merchant) are in the "right" in being allowed to keep the money they charged to the customer's card.
If in fact they (the merchant) are in the "right", the chargeback will be reversed and they will get their money back (mind you, they got charged a chargeback fee when the chargeback was initiated and that chargeback fee is not refunded to them should they be successful in reversing the chargeback, but they do get the money back for the charges. They lose that chargeback fee but that's the cost of doing business and taking payment via credit cards. They agree to accept this fact when they signed up for the merchant account with their merchant account provider/merchant bank).
So for CCI to sue you and spend all that money in a lawsuit when they simply have to dispute the chargeback given the channel provided, it seems very strange.
Besides, everyone and every company knows that suing for less than $10K is usually not cost effective and like I said, since they already had a channel to dispute the chargeback, then why would they spend money on a lawsuit for $5K? Very odd, indeed.
I would also venture to guess that unless you, Helen T., can provide absolute proof of your claim that you are being sued by CCI for $5K over a chargeback your CC company initiated because of a dispute you made to the charges they (CCI) initiated on your card, I have to say that your post is very suspect. I'm not saying you're lying, but something just doesn't add up here.
I will have to take your post with a grain of salt (and advise others to as well) and even assume that you ***might*** be in "cahoots" with CCI - going around to forums scaring people out of disputing CC charges by CCI.
Sorry, again I may be wrong, but until further proof is given that's what I have to conclude as a rational-minded, always-suspect consumer.

| PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE YOU FILE A LAWSUIT OR EVEN WASTE TIME THINKING ABOUT IT. It has been done before, but never successfully. In fact, the last dodobird who tried it ended up being ordered to pay more than $77,000 in attorney fees ($65,000+ to my attorneys and $12,000+ to my co-defendant's legal advisor).
If your attorney is worth his salt, he's going to tell you that the expense of filing a lawsuit you can't win is a whole lot worse than any "damages" resulting from messages posted on this insignificant little chunk of cyberspace. NEWS FLASH: I didn't just climb down off that ol' turnip truck yesterday. I'm well aware that expressing a negative opinion, relating one's personal experience, and restating provable facts are all legal in this country and do not constitute libel, slander, or defamation -- so you don't want to play games with me, and you sure don't want to start something you aren't prepared to finish. I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?). I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!" Do yourself a favor and turn your legal team loose in greener pastures. In closing, I would like to remind you once again that it is still legal, in this great country of ours, to express a PERSONAL OPINION, as long as it is presented as opinion and not as fact. And finally, all you scammers out there will do well to remember that TRUTH IS AN ABSOLUTE DEFENSE against charges of libel, defamation, and slander... so if you're operating just a hop, skip, and jump ahead of the law, you might want to think twice before doing anything stupid... (AND SHAME ON YOU!!). |
