Exactly......good point.
And if their "basis" of suing you is that by initiating a chargeback you (the customer) caused them monetary losses or any other loss, then they have no case. Because........
You, the credit card user, are WELL WITHIN your rights to dispute any charge to your card that you see fit and the credit card company is WELL WITHIN their right to initiate a chargeback for that charge as a result of agreeing with your dispute (they have the ultimate say).
As I said in my other post, they (the merchant) agree to these terms when they agree to accept VISA, MC, Discover, and AMEX (as well as other cards) for payment.
If in fact they are suing you for this reason for $5K, they have no case...no chance in hell. And if you (the defendant/credit card consumer) are not counter suing them for everything you can sue them for INCLUDING (but not limited to) YOUR legal fees, then YOU are screwing yourself and YOU and your lawyer are not doing things properly (and your lawyer is an incompetent boob. But maybe it's OK because I can see this lawsuit, if it's real, being thrown out).
Again, I am still VERY skeptical (VERY skeptical) about this whole deal of the $5K lawsuit, period.

I don't take threats lightly, and I don't accept bribes (or did you call it a "mutually-beneficial arrangement"?). I'll turn you in faster than you can yell, "ARREST ME, I'M SCUM!!" Do yourself a favor and turn your legal team loose in greener pastures.
